I've been throught smog check twice in Los Angeles and twice in Phoenix. No one has even noticed that my engine is a 3.3l. I think they just want to verify that your fuel system is not leaking and your exhaust does not exceed an acceptable amount.
If everything is operating properly, you'll be fine. If K&N enables more air, the engine sends more fuel. With the O2 sensor, the engine constantly varies rich and lean in order to enable the catalytic converter to do its thing.
Anyway, don't worry, I suspect the K&N is a 50-state mod.
